Terms of Service
Last updated 10 September 2026
These terms cover the hosted UpControl service at upcontrol.io. Using the service means accepting them. They are written to be read, not to be survived.
Who you are dealing with
UpControl is operated by an independent sole trader based in Finland. Payments are sold and processed by Creem, our merchant of record, who is the seller on your receipt and handles billing and tax. Contact for anything at all: contact@upcontrol.io.
The service
UpControl runs checks against addresses you give it, accepts events and logs your applications send it, publishes status pages, and sends alerts. What each plan includes is on the pricing page, and that page is the authoritative description of what you get.
Measurements of publicly reachable hosts are also published on automatically created status pages, and the host's owner can have a page removed (the Privacy Policy says how).
Your account
You need an account to use anything beyond the public pages. Keep your sign-in address and your API keys to yourself: anything done with your key is treated as done by you. A key can be revoked from the app at any time, and a leaked one should be. You are responsible for the people you invite into your workspace.
Plans, prices and billing
There is a free plan and there are paid plans. Every price is on the pricing page, in US dollars, and that page is the only place prices are stated. Paid plans are charged monthly or yearly in advance, and they renew automatically until you cancel.
Moving to a more expensive plan takes effect immediately and the difference is charged then. Moving to a cheaper plan takes effect at the end of the period you have already paid for, so you keep what you bought. Taxes are calculated and charged by Creem according to where you are.
Cancelling and refunds
You can cancel at any time, yourself, from the billing portal linked in your account. The plan stays active until the end of the period you have paid for, and then drops to the free plan. We do not delete your data because you cancelled, but the free plan's retention window applies from that point.
If the service did not do what this site says it does, write to contact@upcontrol.io within 14 days of a charge and we will refund it in full. Beyond that window we look at refund requests case by case, and we would rather refund you than argue.
What you may not do
- Use the service to attack, flood or probe systems you do not control.
- Point checks at addresses you have no right to monitor.
- Send us data you have no right to hold, or use alerts to send unsolicited mail.
- Resell the hosted service as your own, or work around plan limits by automation.
- Break the law with it, or use it to help someone else break the law.
Checks are rate limited and the plan limits are enforced by the software. If usage threatens the service for everyone else we may throttle it, and we will tell you why.
Your data
What you send us stays yours. We store and process it to run the service, and for nothing else: we do not mine it, sell it or train anything on it. You can export it and you can delete it. How we handle personal data is in the Privacy Policy.
Availability
We run this carefully and we watch it with itself, but the service is provided as is, without an uptime guarantee. There is no SLA on any plan today, and we would rather say so than print a number we do not measure. Planned maintenance is announced on our own status page.
Open source
The core of UpControl is published under the AGPL-3.0 and you may run it yourself, free, with no time limit. These terms do not apply to that: your self-hosted installation is governed by the licence in the repository, and we provide no support or warranty for it.
Liability
UpControl is a monitoring tool, not an insurance policy. It can miss an incident, and a failure to alert is not a promise broken. To the extent the law allows, we are not liable for indirect or consequential loss, for lost revenue, or for damage caused by an alert that arrived late or not at all. Where liability cannot be excluded it is limited to what you paid us in the twelve months before the claim. Nothing here limits liability for fraud, for death or personal injury, or for anything else that cannot lawfully be limited, and nothing here removes the statutory rights of a consumer.
Ending it
You can close your account whenever you like. We may suspend or close an account that breaks these terms, and except where the breach is serious or unlawful we will tell you first and give you a chance to fix it. If we discontinue the service we will give at least 30 days' notice and refund the unused part of any prepaid period.
Changes to these terms
We update the date at the top when these terms change, and we email account holders before a material change takes effect. Continuing to use the service after that means accepting the new version.
Law and disputes
These terms are governed by Finnish law. If you are a consumer resident in the European Union, you keep the protection of the mandatory consumer law of the country you live in, and you may bring a claim in your own courts. We would much rather settle it by email: contact@upcontrol.io.
